Khaiyum’s legal mistake

Interim AG seems oblivious to the serious legal mistake he caused prompting Government House to release a statement to his defence, which is legally flawed.

Khaiyum in his defence said:

‘If I was going to make a legal mistake, I would say to continue as chairperson, notwithstanding the provisions of section 71. It’s a mistake in terms of the empirical evidence as opposed to the legal issues. Let’s not gone down that path. It’s not a legal mistake.’

Interim AG did in fact make a legal mistake and a serious one at that.

He refers to section 71, but I counsel him to read section 76(3):

‘76(1) The Constituency Boundaries Commission consists of:
(a) a chairperson; and
(b) 2 other persons.
(2) The chairperson must be a person who is, or is qualified to be, a Judge.
(3) The chairperson is appointed by the President, acting in his or her own judgement, following consultation with the Prime Minister and the Leader of the Opposition.’

The Interim AG’s legal mistake is that he is neither the Prime Minister nor the Leader of the Opposition; therefore, he cannot consult with President Iloilo regarding the chairperson of the Constituency Boundaries Commission.

Yet, Khaiyum maintains he will always adhere to the provisions of the Constitution!

The statement from Government House further compounds this mistake.

It mistakenly assumes Khaiyum has a constitutional role to play in the appointment of a Chairperson to the Constituency Boundaries Commission, whereas section 76(3) excludes him altogether.

It said:

‘The mistake has been ratified and we look forward to working with the Attorney-General in appointing a Chairperson of the Constitutuency Boundaries Commission.’


This statement is legally flawed because the Interim AG has no constitutional role whatsoever to play in the appointment of a Chairperson to the Constituency Boundaries Commission.

This statement is real evidence of substandard legal advice being provided to President Iloilo.

Section 76(3) requires that he act on his own judgement, when appointing the chairperson of the Constituency Boundaries Commission.

The Government House statement further raises questions regarding his mental competence and in particular, the issue of whether President Iloilo can ascertain for himself his constitutional duties?

LEST WE FORGET

Bubu has been reading draunimoli leaves in between pinning donkey's ears to voodoo dolls, and attending the Tongan School of rote learning on how to welcome foreigners off planes.

And Bubu got to wondering with all the posturing that went on in Tonga and the purchase of a new suit at taxpayers expense in New York to stand at the UN podium to lie to the world about why Franksie is Fiji's saviour .......

Give it up all of you who are profiting from this sinful regime and who are dragging the rest of the country down the proverbial sewage pipe and most of all , STOP the cowardice which is hiding behind the gun!

There is nothing wrong with our Constitution. It is the basis upon which the rule of law stands and respect for the rule of law lies.

The rule of law embodies the simple principle that all state officials, whether elected or non-elected, should act within the law and the constitution, on the basis of powers that are legally circumscribed.

So far all we have seen of these coup-takers is a blatant disregard of and perversive warping of our law's (and interpretations of our laws), and brazen interference with the organs of State.

The people behind this coup are attacking and raping the very core of what makes us uniquely Fijian. And in the process trying to destroy the moral, lawful and spiritual fabric of our society.

Let us jointly stop this process now . Do not support this Charter (Shudder !)

Revocation Of Independence - Royal Announcement

To the citizens of Fiji:

In the light of your failure to stamp out dictatorship and to govern yourselves again, we hereby give notice of the revocation of your independence, effective today.

Her Sovereign Majesty Queen Elizabeth II will resume monarchical duties to cover all islands, villages and qoliqoli. Except Turtle Island, which she does not fancy.

The leader of this 3% junta party ,
"RHV "(really horrid vore iPM) and those who supported him (who have been until now unaware that there was a world outside their borders) will be banished to Mavana Reef where Vore will be allowed to appoint a Minister to read between the lines without the need for further elections. Cabinet , the GCC , Judiciary , Police Force and the Parliament on Mavana Reef will be disbanded while they await the President's decisions , a black list of 8,500 reef fish will be watched, and the reef perimeter monitored for incitement. A questionnaire will be circulated next year to determine whether any of you noticed.

To aid in the transition to a British Crown Dependency, the following rules are introduced with immediate effect:

1. You should look up "arrogate" in the Oxford English Dictionary. Then look up "abrogate". You will be amazed at just how the RHV and his merry band have been misusing these words . We would not want you to get confused and give up half way through the People's Shudder or Chunder however that is spelt. If you do, just ask Matacajiutasi for some of that stuff he drinks for communion.

6. Bainimarama should stop playing 15's rugby against his body guards as it's too embarrassing. In fact he will no longer be allowed to play it, and should instead play proper 7's to match the number of bodyguards on each flank. Initially, it would be best if he played with the girls. It is a difficult game but he will blend in with his pink pants and sniper-target's-bullet vest on. Those of whom in this team brave enough, will, in time , be allowed to play proper 15's rugby again after intense counselling . 7. You should declare war on Tonga and Rabi, using nuclear weapons donated from India if they give you any resistance.
